CalPERS retirees who return to work must meet specific post-retirement employment conditions, including hourly limitations, pay rate requirements, and a 180-day waiting period unless an exception applies. Departments must consult with Human Resources prior to offering employment to a CalPERS retiree to ensure compliance with applicable laws and university policy. Enrolled employees who separate from Cal State Monterey Bay or whose appointment falls below eligibility status are also eligible for the Consolidated Omnibus Budget Reconciliation Act (COBRA) benefit. UP sends a written notice to every benefit-eligible employee and his/her family about COBRA rights as well as procedures for continued group coverage (also available in Related documents).

If your dependent(s) can no longer participate in a benefit plan due to a loss in eligibility, they may continue their plan coverage under COBRA. You and the dependent(s) affected will receive advance notice from CalPERS or the insurance carrier when benefits are to be terminated due to loss in eligibility. COBRA participants pay the COBRA rates of continued group coverage.

Under federal law, the employee or family member has the responsibility to inform UP of a divorce, legal separation, termination of a child's dependency, or Social Security Disability determination within 60 days of the date of these events.

Employment After Retirement

A CalPERS retiree cannot serve, be employed by or be employed through a contract directly by a CalPERS employer unless he or she either reinstates or his or her employment satisfies the following conditions:
